New Legislative Proposal

Dear Stakeholders,

Ontario One Call and the Ministry of Public and Business Service Delivery have been working together to improve the process of facilitating timely locates as Ontario safely builds the province’s infrastructure faster. 

In 2023, multiple consultations were held with stakeholders. The feedback received informed the regulatory proposal that was recently available for feedback. Today, the ministry has published the Building Infrastructure Safely Act, 2023, a new legislative proposal which introduces additional changes to enhance the locate process and support the transformation of Ontario One Call.

The legislative proposal includes the following changes:

  1. Prohibition from charging for locates by underground infrastructure owners/operators
  2. Removal of the excavator recourse provision
  3. Alignment of Ontario One Call’s powers with other administrative authorities.
  4. Enhancement of Ministry’s regulation-making powers to support future regulation improvements under the Act.

The legislative proposal can be found here. We encourage you to review it and provide your written feedback via the Regulatory Registry. Feedback is due by December 22, 2023.
