Dear Stakeholders,
Following consultations with the industry, the Ministry of Public and Business Service Delivery and Procurement developed a new regulation under the Ontario Underground Infrastructure Notification System (OUINS) Act, 2012 that would allow designated broadband projects to have the option of using the Dedicated Locator (DL) Model or the standard locate process to locate underground infrastructure. The regulation took effect on October 9, 2024.

Background
What does the regulation entail?
The regulation allows designated broadband projects to have the option of using the standard locate process to locate underground infrastructure if their project meets the following criteria:
- The affected Underground Infrastructure Owners (UIO) and the Project Owner (PO) have not agreed on a Dedicated Locator Service Provider (DLSP); and
- The project takes place in Northern Ontario as defined by the OUINS Act (i.e., territorial districts of Algoma, Cochrane, Kenora, Manitoulin, Nipissing, Parry Sound, Rainy River, Sudbury, Thunder Bay and Timiskaming and the City of Greater Sudbury); or
- All or part of the project is located in a local municipality (single-tier municipality or a lower-tier municipality) as defined by the Municipal Act, 2001 with a Census population of less than 100,000 people based on the most recent Census data published by Statistics Canada.
Ontario One Call must be notified in instances where the Dedicated Locator model will not be used in accordance with the conditions stipulated in the new regulation. Please review the Notice To Use Standard Locate Process for Designated Broadband Projects.

What is the intent of the regulation?
This regulation is intended to support the government’s commitment to bring high-speed internet access to unserved and underserved homes and businesses by the end of 2025.
